2. Scope

These Terms and Conditions apply to all orders placed by consumers and business customers through the online store EinfachKlever.com.

Any conflicting or deviating terms of the customer shall not apply unless expressly agreed to by us in writing.

3. Formation of Contract

The presentation of products in our online store does not constitute a legally binding offer but rather an invitation to submit an order.

By placing an order, the customer submits a binding offer to purchase the selected products.

A purchase contract is concluded only upon our express order confirmation or upon shipment of the goods, whichever occurs first.

4. Prices and Payment

All prices displayed in our online store are final prices and do not include shipping costs unless otherwise stated.

Available payment methods are displayed during the checkout process.

Payment is due immediately upon completion of the purchase.

5. Delivery

All orders are shipped directly from Thailand.

Delivery times are estimates only and may be affected by customs clearance, governmental inspections, transportation delays, holidays or other circumstances beyond our reasonable control.

We shall not be liable for delays in delivery except in cases of intentional misconduct or gross negligence where required by applicable law.

6. Import Regulations, Customs and Taxes

The buyer is solely responsible for determining whether the ordered products may legally be imported, possessed, used or resold in the destination country.

The buyer is responsible for all costs, obligations and risks relating to:

  • Import regulations
  • Customs clearance
  • Import VAT
  • Value Added Tax (VAT)
  • Customs duties
  • Handling or brokerage fees
  • Import permits
  • Any other national taxes or charges

Orders shipped internationally may be subject to customs duties, VAT, import taxes or other governmental charges imposed by the destination country.

These charges are not included in the purchase price and remain the sole responsibility of the buyer.

If a shipment is refused, seized, destroyed, delayed or returned due to import restrictions, missing permits, customs regulations or governmental actions, no refund will be provided for shipping costs, customs charges or any other expenses incurred.

The buyer is solely responsible for complying with all customs and import requirements in the destination country.

7. Right of Withdrawal

Where required by applicable consumer protection laws, consumers may have a statutory right of withdrawal.

Details are provided in our separate Right of Withdrawal Policy.

The current version of the Right of Withdrawal Policy shall apply.

8. Returns

Returns must be sent to our address in Thailand.

Where permitted by applicable law, the buyer is responsible for the direct cost of returning the goods.

The buyer is also responsible for all customs procedures, export documentation, import duties, taxes and related fees associated with returning goods.

Returns sent freight collect or without sufficient postage will not be accepted.

Refusing delivery or failing to collect a shipment from the carrier or customs authorities does not constitute a valid withdrawal from the purchase contract.

Any return shipping costs, storage charges, customs duties, handling fees or original shipping costs incurred may be deducted from any applicable refund.

Refunds will only be processed after the returned goods have been received and inspected.

9. Warranty

Statutory warranty rights shall apply where mandatory under applicable law.

Minor differences in colour, design, packaging, labelling or manufacturer presentation shall not constitute a defect provided that the functionality and intended use of the product are not materially affected.

10. Limitation of Liability

We shall be fully liable for damages resulting from intentional misconduct, gross negligence or injury to life, body or health where required by applicable law.

To the fullest extent permitted by law, our liability shall otherwise be limited to foreseeable damages typically arising from the contract.

We shall not be liable for delays, customs actions, import restrictions, confiscations, governmental measures or actions taken by shipping providers beyond our reasonable control.

11. Product Information

Information regarding traditional uses, herbs, natural products, wellness products or generally known product characteristics is provided for general informational purposes only.

Such information does not constitute medical advice, diagnosis, treatment, therapeutic claims or guarantees of effectiveness.

Always consult a qualified physician, pharmacist or other healthcare professional regarding medical concerns.

12. Privacy

The processing of personal data is governed by our separate Privacy Policy.

13. Governing Law

These Terms and Conditions shall be governed by the laws of the Kingdom of Thailand, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection laws of the customer's country of habitual residence provide otherwise.

14. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

Any invalid provision shall be replaced, to the extent permitted by law, by a valid provision that most closely reflects the original economic purpose.
